Critical, long-overdue BlackBerry makeover arrives

TORONTO (AP) ? BlackBerry maker Research In Motion Ltd. will kick off a critical, long-overdue makeover when chief executive Thorsten Heins shows off the first phone with the new BlackBerry 10 system in New York on Wednesday.

Repeated delays have left the once-pioneering BlackBerry an afterthought in the shadow of Apple's trend-setting iPhone and Google's Android-driven devices. There has even been talk that the fate of the company that created the BlackBerry in 1999 is no longer certain.

Now, there's some optimism. Previews of the BlackBerry 10 software have gotten favorable reviews on blogs. Financial analysts are starting to see some slight room for a comeback. RIM's stock has more than doubled to $15.66 from a nine-year low in September, though it's still nearly 90 percent below its 2008 peak of $147.

RIM redesigned the system to embrace the multimedia, apps and touch-screen experience prevalent today. The company is promising a speedier device, a superb typing experience and the ability to keep work and personal identities separate on the same phone.

Most analysts consider a BlackBerry 10 success to be crucial for the company's long-term viability. Doubts remain about the ability of BlackBerry 10 to rescue RIM.

"We'll see if they can reclaim their glory. My sense is that it will be a phone that everyone says good things about but not as many people buy," BGC Financial analyst Colin Gillis said.

Jefferies analyst Peter Misek called it a "great device" and said RIM does have some momentum just months after the Canadian company was written off for dead.

"Six months ago we talked to developers and carriers, and everybody was just basically saying 'We're just waiting for this to go bust,'" Misek said. "It was bad."

The BlackBerry has been the dominant smartphone for on-the-go business people and crossed over to consumers. But when the iPhone came out in 2007, it showed that phones can do much more than email and phone calls. Suddenly, the BlackBerry looked ancient. In the U.S., according to research firm IDC, shipments of BlackBerry phones plummeted from 46 percent of the market in 2008 to 2 percent in 2012.

RIM promised a new system to catch up, using technology it got through its 2010 purchase of QNX Software Systems. RIM initially said BlackBerry 10 would come by early 2012, but then the company changed that to late 2012. A few months later, that date was pushed further, to early 2013, missing the lucrative holiday season. The holdup helped wipe out more than $70 billion in shareholder wealth and 5,000 jobs.

Although executives have been providing a glimpse at some of BlackBerry 10's new features for months, Heins will finally showcase a complete system at Wednesday's event. Devices will go on sale soon after that. The exact date and prices are expected Wednesday.

Regardless of BlackBerry 10's advances, though, the new system will face a key shortcoming: It won't have as many apps written by outside companies and individuals as the iPhone and Android. RIM has said it plans to launch BlackBerry 10 with more than 70,000 apps, including those developed for RIM's PlayBook tablet, first released in 2011. Even so, that's just a tenth of what the iPhone and Android offer. Popular service such as Instagram and Netflix won't have apps on BlackBerry 10.

Gillis said he'll be looking to see when RIM releases a keyboard version of the new phone. The first BlackBerry 10 phone will have only a touch screen. RIM has said a physical keyboard version will be released soon after. He said a delay could alienate RIM's 79 million subscribers.

"The No. 1 feature that they like is the physical keyboard," Gillis said.

New BlackBerry to Be 'Most Comprehensive in Mobile History'

RIM is finally ready with its answer to Apple's iPhone and the many Android smartphones. After months of delays, RIM CEO Thorsten Heins, along with others from the company, will take the stage Wednesday in New York to unveil the final version of BlackBerry 10, the next version of RIM's phone software, and the phones that will run it.

"We expect tomorrow to really be the kickoff for the introduction of Blackberry 10," RIM's Chief Marketing Officer Frank Boulben told ABC News in a phone interview. "We have been engaged for quite a period of time with the two main constituents -- the carriers and the developers -- and we've already said we are in the labs of more than 150 carriers around the world."

With more than 150 wireless carriers around the world planning to offer the latest BlackBerry, Boulben says it will be the most "comprehensive launch," not only for the company, but in the history of the mobile industry.

"This makes it the most comprehensive launch in mobile history. There has never been a platform launching with that many carriers," he said. When the iPhone 5 made its debut in September it actually had more -- Apple said there would be 240 carriers by December. But Boulben points out that BlackBerry 10 is an entirely new operating system that doesn't share a single line of code with previous BlackBerry software; the iPhone 5 and iOS 6, by contrast, was essentially an upgrade.

At Wednesday's event the company will show its new handsets in detail. RIM is expected to release a touch-screen device called the Z10 and another with a physical keyboard. AT&T, T-Mobile and Verizon have said they will carry devices that run the new software. Boulben also said RIM will highlight major differences between BlackBerry 10 and the other leading mobile phone platforms.

"We are highly differentiated in four areas," Boulben said. The first is with communications -- RIM has designed the software around a messaging hub and new multitasking features. The second: the touch keyboard, which predicts words as you are typing them. Lastly, RIM says its BlackBerry Messenger and its BlackBerry Balance feature, which separates work from personal uses on the phone, set it apart.

Boulben would not address specifically how much market share RIM is hoping to gain back in the U.S., having lost the lead it had in the last decade. According to Kantar Worldpane ComTech's data released in November 2012, the BlackBerry brand only had 1.6 percent of the American smartphone market. The iPhone had 48.1 percent of the market and Android had 46.7.

"It's a change in smartphone experience -- the dominant paradigm, introduced six years ago, was great and revolutionary at the time. But six years is a long time for a technology cycle, with a new user experience with a clear focus we have the opportunity to take market share back," Boulben said.

RIM CMO: BlackBerry 10 Will Make Others Look Outdated

While RIM is of course bullish about its new products, it faces one big challenge it might not be able to control: apps. While the platform might be innovative, it will trail behind the Apple App Store and Google Play Store in variety of apps. Boulben says the momentum around apps is strong and that Wednesday the BlackBerry World store will launch with 70,000 new apps.

RIM BlackBerry 10 Launch

Apps that worked on previous BlackBerry 7 devices won't work on the BlackBerry 10 platform, since it is completely new. Analysts say that apps are bound to be the pain point for the platform, but it's not too late to rule out RIM from taking back at least some of what it has lost.

"Given the speed that the market is moving, it's hard to be dismissive of RIM given the strength of their brand and continued loyalty of many users," Michael Gartenberg, Gartner Research Director, told ABC News. "It will be important for RIM to show tomorrow how they've evolved the BlackBerry to meet the challenges of other platforms and at the same time show positive differentiation."

And that seems to be exactly RIM's plan. "The time was right to switch to a new platform, one that will allow us to continue true to our DNA but also take it to the next level," Boulben said. "It is a major undertaking for the company. It has been two years in the making, but we are ready."

RIM's BlackBerry 10 event begins at 10:00 a.m. ET on Jan. 30, 2013. ABC News will be reporting on the news throughout the day.

New Michigan Laws on Independent Contractors Now in Effect | The ...

If your business regularly utilizes the services of a person who you have designated to be an Independent Contractor, you should be aware that there has been a change in the Michigan Workers? Compensation law pertaining to whether your company would be considered the independent contractor?s employer and liable for his/her workers? compensation benefits. As of January 1, 2013, the Michigan legislature enacted a 20- factor test to determine if an employer/employee relationship exists for workers? compensation liability. The 20-factors are:

1. INSTRUCTIONS: If your business requires the contractor comply with its instructions about when, where and how the service is to be done, the contractor could be considered an employee.

2. TRAINING: If your business requires that the contractor perform the job in a particular manner then the contractor could be considered an employee. An independent contractor will use his/her own methods be complete the agreed upon service and should receive no training from your business.

3. INTEGRATION: If the services performed by the contractor are an important part of your business operation then the contractor could be considered an employee. The integration of the two businesses indicates that the contractor is subject to your direction or control.

4. SERVICES RENDERED PERSONALLY: If the contractor is required to perform the service personally is an indication that contractor is an employee since an independent contractor is free to assign work to his/her own employees if necessary.

5. HIRING, SUPERVISION AND PAYING ASSISTANTS: If the business allows the contractor to hire, supervise or pay assistants for the business, the contractor is likely to be deemed an employee unless the contract specifies that the contractor will hire and supervise other as part of the contract.

6. CONTINUING RELATIONSHIP: If the business and contractor have an ongoing relationship for the service provided, the contractor could be considered an employee. The IRS has held that even irregular recurring jobs would qualify as an employment relationship.

7. SET HOURS OF WORK: If the business requires the contractor to work a set number of hours, the contractor could be considered an employee since an independent contractor sets his/her own schedule.

8. FULL TIME REQUIRED: If the business requires the contractor to work substantially full time for the business, the contractor will likely be considered an employee since an independent contractor is typically free to work when and for whom he or she chooses.

9. WORK DONE ON PREMISES: If the business requires that the services being performed are completed on the business? premises, the contractor could be considered an employee, especially if the service could be performed elsewhere.

10. ORDER OR SEQUENCE TEST: If the business requires that the service be performed in a certain order, the contractor could be considered an employee since the independent contractor should be allowed to perform the services in whatever order he/she deems appropriate.

11. ORAL OR WRITTEN REPORTS: Any contractor required to submit regular reports would suggest an employee relationship since it is a method of controlling the contractor.

12. PAYMENTS BY THE HOUR, WEEK OR MONTH: Payment of wages by a set schedule would suggest an employment relationship since independent contractors are traditionally paid by the job and/or commission.

13. PAYMENT OF BUSINESS AND/OR TRAVELING EXPENSES: If the business pays the contractor?s expenses, the contractor would be considered an employee.

14. FURNISHING TOOLS AND MATERIAL: If the business provides the tools and material necessary for the contractor to complete the service, the contractor would likely be considered an employee.

15. SIGNIFICANT INVESTMENT: If the contractor maintains his or her own office, no employment relationship would be presumed.

16. PROFIT OR LOSS: If the contractor can realize a profit or loss by his or her services, then no employment relationship would be presumed.

17. WORKING FOR MORE THAN ONE FIRM AT A TIME: If the contractor performs more than de minims services for other businesses then no employment relationship would be presumed.

18. MAKING SERVICE AVAILABLE TO THE GENERAL PUBLIC: If the contractor makes his or her services available to the public on a regular or consistent basis then no employment relationship would be presumed.

19. RIGHT TO DISCHARGE: If the business has the right to discharge the contractor, then an employment relationship could be established. A business? right to end the relationship with an independent contractor is typically controlled by the terms of the contract.

20. RIGHT TO TERMINATE: If the contractor has the right to terminate the relationship with the business without incurring liability, then an employment relationship could be established.

These factors are fairly general and some will likely apply to your business relationship with an independent contractor. The Michigan legislature has implemented a process where a business can request a hearing to determine if the contractor performing services is covered with an employment relationship but this request for a hearing will likely take too long for the services to be relevant.

It should be noted that the workers? compensation liability for injuries sustained by an independent contractor or his/her employees will only revert back to your business ?if? the contractor does not have workers? compensation insurance of his/her own. As such, if your business needs to hire an independent contractor to perform services, it is wise to request a copy of the contractor?s certificate of insurance for workers? compensation and even follow up with a call to their agent to ensure that the insurance coverage is still in effect. Beware, if your independent contractor did not have workers? compensation coverage and a claim is filed against your workers? compensation carrier, your insurance carrier has the right to audit your records and raise your premium for those uninsured contractors.

Mali military enters fabled town of Timbuktu

SEVARE, Mali (AP) ? Backed by French helicopters and paratroopers, Malian soldiers entered the fabled city of Timbuktu on Monday after al-Qaida-linked militants who ruled the outpost by fear for nearly 10 months fled into the desert, setting fire to a library that held thousands of manuscripts dating to the Middle Ages.

French Col. Thierry Burkhard, chief military spokesman in Paris, said that there had been no combat with the Islamists but that the French and Malian forces did not yet control the town.

Still, there was celebration among the thousands of Timbuktu residents who fled the city rather than live under strict and pitiless Islamic rule and the dire poverty that worsened after the tourist industry was destroyed.

"In the heart of people from northern Mali, it's a relief ? freedom finally," said Cheick Sormoye, a Timbuktu resident who fled to Bamako, the capital.

Timbuktu, a city of mud-walled buildings and 50,000 people, was for centuries a seat of Islamic learning and a major trading center along the North African caravan routes that carried slaves, gold and salt. In Europe, legend had it that it was a city of gold. Today, its name is synonymous to many with the ends of the earth.

It has been home to some 20,000 irreplaceable manuscripts, some dating to the 12th century. It was not immediately known how many were destroyed in the blaze that was set in recent days in an act of vengeance by the Islamists before they withdrew.

Michael Covitt, chairman of the Malian Manuscript Foundation, called the arson a "desecration to humanity."

"These manuscripts are irreplaceable. They have the wisdom of the ages and it's the most important find since the Dead Sea Scrolls," he said.

The militants seized Timbuktu last April and began imposing a strict Islamic version of Shariah, or religious law, across northern Mali, carrying out amputations and public executions. Women could be whipped for going out in public without wearing veils, while men could be lashed for having cigarettes.

Just over two weeks after the French began their military intervention in Mali, French and Malian forces arrived in Timbuktu overnight, the French military spokesman said Monday.

"The helicopters have been decisive," Burkhard said, describing how they aided the ground forces who came from the south as French paratroopers landed north of the city.

But the French have said Mali's military must finish the job of securing Timbuktu. And the Malians have generally fared poorly in combat, often retreating in panic in the face of well-armed, battle-hardened Islamists.

During their rule in Timbuktu, the militants systematically destroyed cultural sites, including the ancient tombs of Sufi saints, which they denounced as contrary to Islam because they encouraged Muslims to venerate saints instead of God.

The mayor said the Islamists burned his office as well as the Ahmed Baba institute, a library rich in historical documents.

"It's truly alarming that this has happened," Mayor Ousmane Halle told The Associated Press by telephone from Bamako. "They torched all the important ancient manuscripts. The ancient books of geography and science. It is the history of Timbuktu, of its people."

Some manuscripts had been removed from Timbuktu or hidden away for safekeeping from the Islamists.

"UNESCO is very concerned about the reports coming out of Timbuktu as to damage on cultural heritage there," UNESCO chief spokeswoman Sue Williams said from Paris.

The destruction recalls tactics used by the Taliban in 2001 when they dynamited a pair of giant Buddhas carved into a mountain in Afghanistan. The Taliban also rampaged through the national museum, smashing any art depicting the human form, considered idolatrous under their hardline interpretation of Islam. In all, they destroyed about 2,500 statues.

Mali's Islamists still control the provincial capital of Kidal farther north and are believed to have dug a network of tunnels, trenches and caves from which they can launch attacks.

Nana Toure, a native of Timbuktu now living in the capital, said she was delighted to hear that the French had arrived but worried how long the Malian soldiers could hold the town without help.

"French troops must not leave us alone then because those who fled may come back and cause problems for us," she said. "French troops have to stay a bit to stabilize the place."

Sony details VAIO T15, touchscreen T14 Ultrabooks on their way to Japan

Sony was mum on most of the details of the VAIO T15 and a touch-upgraded T14 when they appeared at CES. We won't have to wait until the spring launch in the US to know what some editions of the Ultrabook will carry, though. At least for Japan's February 9th release, the T15 won't be running any Haswell-based parts -- the top-spec system carries a 2GHz Core i7 from the current generation, a BDXL drive and a 1TB hybrid hard disk. The touch-ready T14 will be just as modest with a 1.8GHz Core i5, a DVD burner and up to 750GB of hybrid storage. We wouldn't be shocked to see performance boosts to either PC before they cross the Pacific, but we at least know what to expect as a baseline.

128GB iPhones get rumored again, this time thanks to iOS 6.1

Some people really want a 128GB iPhone, iPod touch, or iPad, so whenever there's a new product refresh coming up, like the presumed iPhone 5S, rumors of higher storage capacities come with them. This time, however, it's the news that iOS 6.1 beta 5 provides support for larger storage capacities that's sent the rumors running. Neal on Twitter posted:

We should be seeing 128GB iDevices soon. iOS 6.1 beta 5 has 128G system partition key in BuildManifest.

Apple has historically increased storage sizes as a product differentiator, and when the cost of the required NAND flash storage made it cost effective to do so. Going from 64GB to 128GB and keeping the same size device means double density flash.

So, going in reverse order, component prices for high density flash would have to be cheap enough for Apple to maintain current prices and margins. And, Apple would have to be in the right place in their product cycle that it's a feature and not a throw-away. From my iPhone 5 preview:

When it comes to storage, Apple has doubled the maximum available capacity every two years. While the original iPhone shipped with an 8GB maximum, a 16GB version was introduced half a year later. The iPhone 3G also had a 16GB maximum. Both the iPhone 3GS and iPhone 4 have 32GB maximums. Last year, Apple doubled that again with the iPhone 4S, hitting 64GB. History, never mind pricing and NAND flash chip density, suggests we'll stay at 64GB for the iPhone 5 and for this year. What happens with a supposed iPhone 5S in another year is another story.

Well, it's that year now, so it's safe to add 128GB to your iPhone 5S, iPod touch 5 mark II, iPad 5, and iPad mini 2 speculation lists.

Whether cloud storage, either Apple's own iCloud or service like Dropbox mitigate the product pressure for 128GB remains to be seen. There will always be some people who want as much as they can have locally on their device -- witness the continued existence of the iPod classic. (And, as Mark Gurman once again points out on Twitter, the former could finally send the latter off to outdated iPod retirement land, presumably somewhere in Florida...)

Heck, Apple could probably offer a 256GB device at $999 and find some segment of the market still asking for more.

The only question is how much storage hits the price and sales sweet spot for Apple in 2013. Do you still need or want more, or has the cloud changed your mind?

Jeter on field for 1st time since breaking ankle

TAMPA, Fla. (AP) ? Derek Jeter has worked out on a baseball field for the first time since breaking his left ankle last October.

The 38-year-old New York Yankees captain fielder 55 grounders on the grass in front of the infield dirt at shortstop Monday at the team's minor league complex. He also hit in a batting cage.

"Everything went well," Jeter says.

The 13-time All-Star expects to start in New York's opener against Boston on April 1. This is the time of year Jeter usually starts his onfield pre-spring training routine.

Jeter broke the ankle lunging for a grounder in the AL championship series opener against Detroit on Oct. 13. He had surgery a week later, and the Yankees said recovery time would be four to five months.

Jeter has been walking on an underwater treadmill at the team's facility since early January.

2013 Farmers Insurance Open: Tee times and TV schedule for ...

It will be a late Monday afternoon finish at Torrey Pines, which should be the site of Tiger Woods' eighth win at the South Course.

The 2013 Farmers Insurance Open will conclude on Monday, with the last group through just seven holes of the final round. In that group is runaway leader Tiger Woods, who carries a six-shot lead into the Monday finish on the South Course at Torrey Pines.

Woods still has 11 holes to play, but even with some off his struggles off the tee late Sunday night, the remaining stretch would appear to be a mere formality on the march to his 75th career victory. Woods missed the first five fairways at the start of his fourth round, but still managed to avoid a bogey and actually extended his lead by two shots with three more birdies. His short game and dominance on the par-5s have created the cushion.

The Monday finish was expected as a full day was lost on Saturday due to dense fog in the area. With 87 players making the cut, and the limited daylight of January, no groups were able to complete the tournament during the dawn-to-dusk play on Sunday. The decision was also made to not repair the players between rounds on Sunday, so Woods continues to play with Billy Horschel and Casey Wittenberg in the last group. The first groups have just three holes remaining in the fourth round.

With all players out on the course, there are no remaining tee times for Monday but play will resume at 2:10 p.m. ET. Golf Channel will have the broadcast from 2:10 up to 4 p.m. ET, at which point CBS will take over and carry coverage of the finish. That should wrap up around 5:30 p.m. ET, and reports on Sunday indicated that CBS asked the Tour for a later start so that they could carry coverage of that late afternoon finish.

The collateral damage of that decision is that some players, such as Tiger's playing partners, have no chance to make it to Phoenix in time for Monday qualifying at the Waste Management Open. There were initial reports that the Tour would try to finish up early on Monday and try and jet those players over to Phoenix in time. Instead, it will be a Monday afternoon conclusion at Torrey Pines -- circumstances similar to Tiger's last win here in the 2008 U.S. Open.

Brent McCarty Biomag millionaire | Stuff.co.nz

EXCLUSIVE: Brent McCarty -?despite his penchant for racing Porsches, recently gifting his wife a $325,000 Bentley convertible, his Takapuna cliff-top mansion and his 60ft luxury launch especially designed to allow golf swings off the loading deck - insists he is just humble Kiwi and would prefer to remain anonymous.

"We're very much people who just like to be under the radar. We're not social scene people about the city. We're just doing our best to keep the economy working," he said.

Before this week the moustached McCarty had never given a media interview, despite being - along with his wife, Yvonne - behind one of the most persistent marketing campaigns New Zealand has seen.

To a large extent McCarty's success has been on the back of Woolrest BioMag, a mattress-cover-and-magnet piece of bedding that is praised by Murray Deaker and written off as pseudoscience by the Skeptics Society.

Advertising for BioMag, relying heavily on advertorials promising "drug-free pain relief", have been regularly subject to complaints to the Advertising Standard Authority - BioMag has won nearly all of the cases, partly by emphasising its therapeutic claims are heavily caveated.

Dr Simon Edmonds, a chemistry lecturer at the Christchurch Institute of Technology, is firmly in the sceptic camp. "I'm not sure slick is the right word - it's very well-thought-out advertising," he said.

Edmonds said a review of scientific literature shows only a few patchy and dubious studies showing positive effects of magnet therapy - and larger studies broadly showing no difference in effect from placebos.

Claims made that magnets help blood circulation and stimulate melatonin production also appeared to be lacking scientific support, Edmonds said.

The United States' National Institute of Health is more blunt in its pamphlet warning about magnet therapy: "Magnets have not been proven to work for any health-related reason, yet static, or permanent, magnets are widely marketed for pain control."

McCarty defends his mattress covers.

"Magnetic therapy goes back a long way - to Roman days, and the Chinese. Cleopatra used it."

McCarty said there are many doctors who recommend BioMag to their patients.

"It's not a cure, we're not saying it's a cure - but it certainly provides a huge amount of pain relief to a lot of people," McCarty said, citing testimonials, which he said are unsolicited.

Regardless of the controversy, BioMag has been a roaring success. Advertising manager and former BioMag director Edward Borrie described it as "a bit of a wonder product".

McCarty was unwilling to talk numbers, but said: "It has been, by New Zealand standards, reasonably successful."

The company's website boasts one in 10 New Zealand

households has purchased the product, and total sales of nearly 500,000 mattress covers. With prices for the company's flagship magnetised products ranging up to $789, annual revenues can be reasonably inferred over the past 10 years to average in excess of $10 million.

Margins are also high, McCarty said.

The origins of the company date back to the early 1990s when McCarty, who controlled the rights to the Woolrest brand, was grappling with ways to spin his fibre into gold.

"At that point, woollen underlays had became a commodity, and the market price-driven. We could have moved it offshore and taken production to China, but we didn't want to do that," he said.

Instead, he teamed up with Australian Thomas Blackhurst, who ran BioMag, and the two products were combined. In 2002 Blackhurst was bought out and the McCartys became sole owners and operators of the company that recently expanded its presence into the United Kingdom and started advertising magnetised blankets for pets.

BioMag isn't McCarty's only trick. The family business was textiles, and various holding companies he controls have the New Zealand and Australian rights for fashion labels such as American Apparel, Black Apple and Minty Meets Munt. For a time, he worked with King Kapisi on the rapper's "Overstayer" label.

McCarty said it was his reputation for direct marketing that encouraged Wayne Tempero, later to become nationally known and charged with firearms offences for his role as Kim Dotcom's bodyguard, to form a partnership distributing a self-defence DVD.

Company filings with the ASX show McCarty has taken punts on biotech start-ups, and still holds a A$2m stake in listed real estate vehicle Audio Pixel Holdings.

And, still with textiles, McCarty recently partnered with his son to move into golfwear in the US. Jason McCarty was a hot golfing prospect, in 2001 earning a tour card on the Australian PGA Tour, before settling down as a club professional at exclusive courses charging eye-watering fees.

McCarty Jr split his time between New Zealand's Cape Kidnappers and Kauri Cliffs and Long Island's Sebonack. The two local courses are owned by billionaire hedge fund owner Julian Robertson, while Sebonack was famous when it opened for its world-leading membership fees of US$625,000.

He married Diane Duvall, then Robertson's director of New Zealand operations, and bought a US$1.1m home in Long Island. The couple then joined forces with McCarty Sr in 2011 to distribute Swedish sportswear Cross Golf into the United States.

McCarty plays down his empire, dismissing questions about whether he should feature on the National Business Review's rich list.

"I don't know about that," he says. "I get three square meals a day. And so does my dog."

(AP) ? Victor Oladipo wasted no time getting Indiana's fans riled up Sunday.

They responded to his energetic play with loud, boisterous support for the next two hours and he responded to their cheers by delivering a performance to remember.

The junior guard finished with 21 points, seven rebounds, six steals and three blocks, leading the seventh-ranked Hoosiers to a 75-70 victory over No. 13 Michigan State on a day Oladipo was already thinking about doing more.

"There are still things I need to improve on, even today," Oladipo said. "So I have to keep getting better."

This one will be hard to top.

Indiana (18-2, 6-1 Big Ten) has won three straight since a Jan. 25 loss to Wisconsin. It has won back-to-back games over the Spartans after ending a six-game losing streak in the series. The Hoosiers picked up their ninth win in Assembly Hall over a Top 25 foe during the past 24 months, and their latest victory helped break up a three-way logjam atop the Big Ten. Indiana was awaiting the result of the Michigan-Illinois game to see if it would share the conference lead with the Wolverines or have it all to themselves.

How much did this win mean to coach Tom Crean?

After shaking hands with his old friend, Tom Izzo, Crean walked to the corner in the south end of Assembly Hall, raised both arms and thanked the students for their constant noise. A few minutes later, he was thanking others.

"He (Oladipo) was a tremendous difference from the start of the game. He had a knowledge base that he put into his game as to how he was going to defend," Crean said. "If you're not cerebral like that and at the same time, quick, it's hard to defend like that. But he's been good. We knew he was going to play well on the offensive end and to take away things on the defensive end, too. And we don't win this game without Will Sheehey, we really don't."

The impact of Oladipo was evident in the box score and beyond.

He was 8 of 12 from the field and 4 of 6 from the line with more offensive rebounds (four) than defensive. Crean also credited him with 15 first-half deflections, something Crean said he's never seen before. And when Oladipo wasn't making plays, there were plenty of others willing to help.

Cody Zeller made only two baskets and finished with nine points but scored on a layup with 1:38 to go to make it a two-possession game. He also took a charge with 14.3 seconds left that essentially sealed the win.

Christian Watford finished with 12 points and six rebounds, Yogi Ferrrell had 11 points and a key 3-pointer just before halftime and Jordan Hulls had 10 points and four assists. Most of it was the result of Oladipo and the threat he posed on every possession.

"That's just Victor," Watford explained. "We feel like we're a great team when Victor does this. He brings a lot of energy. Not only that, he gets us open by the way he attacks the basket. He did a great job today."

Michigan State (17-4, 6-2) just couldn't keep up.

Gary Harris, last year's Indiana Mr. Basketball was booed relentlessly, yet made five 3-pointers and finished with 21 points. Adreian Payne added 18 points and was 3 of 4 from beyond the arc, matching his season total of three 3s. The only other player to reach double figures was Branden Dawson, another Indiana native, who has 12 points and eight rebounds.

Still, it wasn't up to Izzo's standards. The Spartans, playing in special green-and-gold uniforms, committed 19 turnovers, allowed Indiana to shoot 50.9 percent from the field and essentially wound up with a rebounding draw, 32-31. Guard Keith Appling fouled out with 5:14 to go, too.

"Our whole deal was to keep them out of the lane and not turn the ball over and we didn't do either one of those very good," Izzo said. "We got tired, and we've been so good down the stretch and with three minutes left, I thought we had a chance."

It was every bit as entertaining as advertised.

After Michigan State took a 31-30 lead late in the first half, Indiana answered with a 3 from Sheehey and another 3 from Hulls. Ferrell's 3 to close the half gave Indiana 44-38 lead.

Oladipo's two free throws with 16:28 to go extended the lead to 50-43, but when it looked like the Hoosiers might pull away, Harris dashed those hopes by making back-to-back 3s over the next 50 seconds to get the Spartans within 50-49.

Indiana never led by more than six the rest of the way, but with Oladipo leading the defense, Michigan State never managed to tie the score or take the lead, either.

The Hoosiers final sealed it in the final 98 seconds when Zeller made the layup and took the charge, and Hulls made 1 of 2 free throws.

"It was a physical game, a hard-nosed game, it was a high-level game and they're a great team," Crean said. "That's why it's a great win for us."

(AP) ? The nominee for U.S. Secretary of State, Sen. John Kerry, once held up millions of dollars in funding for secretive U.S. democracy-building programs in Cuba. Defense Secretary hopeful Chuck Hagel has called the U.S. embargo against the communist-run island "nonsensical" and anachronistic.

Both men are now poised to occupy two of the most important positions in President Barack Obama's Cabinet, leading observers on both sides of the Florida Straits to say the time could be ripe for a reboot in relations between the longtime Cold War enemies ? despite major obstacles still in the way.

Kerry's confirmation hearing was held last Thursday, with Hagel's likely to begin next Thursday. In a day marked by platitudes and praise from his longtime colleagues, the Massachusetts Democrat up for top U.S. diplomat sidestepped two questions on Cuba without giving any hint of his opinion on bilateral relations.

Yet Kerry's record has showed some openness to relaxing the tough U.S. stance on Cuba.

"I think having a secretary of state and secretary of defense who understand and are willing to speak publicly that isolation is counterproductive is a very good start," said Tomas Bilbao, executive director of the nonpartisan Cuba Study Group, which advocates using engagement to spur democratic change. "I'm optimistic about the opportunity."

Carlos Alzugaray, an ex-Cuban ambassador to the European Union and the author of several studies about Cuba-US relations, said that if both men are confirmed, no Cabinet since the Carter administration would have such high-level voices in favor of rapprochement.

At the same time, the composition of Cuban-Americans in Florida is evolving, with younger voters less emotionally attached to the issue than their parents and grandparents. Exit polls showed 49 percent of Cuban-Americans in the state voted for Obama, roughly the same percentage as four years ago, an indication the group no longer plays the make-or-break role it once did in presidential politics.

The atmosphere is changing in Cuba as well.

Alzugaray noted that the island has taken many steps that would normally be welcomed by Washington such as freeing dozens of political prisoners, opening the economy to limited capitalism, hosting peace talks for war-torn Colombia and eliminating most restrictions on travel for its own citizens.

"Cuba is changing, and it is changing in the direction that the United States says Cuba must change," Alzugaray told The Associated Press in an interview in his Havana apartment.

The greatest obstacle to better ties is undoubtedly the continued imprisonment of U.S. contractor Alan Gross, who is serving a 15-year sentence for crimes against the state after he was caught setting up clandestine Internet networks as part of a U.S. Agency for International Development democracy-building program.

Havana has insisted the 63-year-old Gross will not be released unless Washington considers freeing five Cuban agents held in the United States. One is out on supervised release but was ordered to remain in the country, and the other four are still incarcerated.

Critics of engagement, including several prominent Cuban-American legislators, say none of the reforms Cuba has made brings the island closer to being a democratic state after 54 years of rule by brothers Fidel and Raul Castro.

Dissidents are still detained and harassed, they say, the Cuban news media is not free, elections are restricted to approved candidates and the Cuban parliament acts as little more than a rubber stamp for decisions made by the island's aging leaders.

Rep. Ileana Ros-Lehtinen, a Havana-born Florida Republican and staunch critic of the Castros, told the AP she was deeply concerned about both Cabinet nominees.

"I think both are bad for strengthening the U.S.-Cuba embargo," she said. "They would work for an appeasement policy. They would work to normalize relations. That is their philosophy. But they won't be able to achieve it."

Ros-Lehtinen said she hoped Kerry's likely replacement as chairman of the Senate Foreign Relations Committee, Cuban-American Democrat Bob Menendez of New Jersey, would block any attempt to take a softer line.

As committee chairman in 2011, Kerry held up millions of dollars in funding for the same program that Gross was involved in, out of concern that it was ill-conceived and a waste of money. He later cut a deal with Menendez to free up the money. At the hearing on Thursday, Kerry said that as secretary of state, he would support such programs worldwide, but did not mention Cuba.

Hagel, a former Republican senator from Nebraska, has termed the 50-year-old trade embargo an "outdated, unrealistic, irrelevant policy" and said the U.S. should engage with the island, just as it does with other communist countries such as Vietnam and China.

In his first term, Obama eliminated restrictions on the number of times Cuban-Americans can visit their relatives on the island, and the amount of money they can send back in remittances. He also has made it much easier for American travelers to get licenses to visit the island on cultural, educational and religious exchanges, though tourism is still barred.

Since 2009, the number of Americans traveling to Cuba has nearly doubled from 52,000 per year to 103,000 in 2012, according to statistics compiled by the firm the Havana Consulting Group. Trips by Cuban-Americans to visit their relatives rose from 335,000 to 476,000 a year during the same period. The surge puts the United States second only to Canada as the source of travelers to the island.

But just as American officials have met Cuban reforms with lukewarm indifference, Cuban leaders have dismissed Obama's overtures as window-dressing, saying he has in many ways strengthened the embargo by going after companies that do business with the island.

Cuban officials have been reluctant to talk about the Kerry and Hagel nominations for fear their words will be used by opponents. But a pro-government Web site, Cubasi, published an opinion piece Thursday detailing both men's past opposition to America's Cuba policy.

"Chuck Hagel has no problem with Cuba," wrote the author, well-known columnist Nicanor Leon Cotayo. "On the contrary, he has demonstrated common sense to do away with one of the White House's most anachronistic foreign policies."

Cotayo added that Obama has "real and legal options to maneuver and diminish tension in bilateral relations."

Others say they are not holding their breath for any change.

Alzugaray, the longtime Cuban diplomat, threw up his hands and shrugged when asked why he was not more optimistic that the stars would align for better relations this time around.

"That dog has bit me several times," he laughed. "I've often thought that now is the time, the possibilities are there, but always something has complicated things."

Scuffles outside PM's office after steel layoffs

(AP) ? Some 250 steel workers from Liege's ArcelorMittal plant have scuffled with police outside the prime minister's office, a day after the leading steel and mining company announced it would close seven facilities in eastern Belgium.

The workers pitched stones at police, who retaliated by using the water cannon in freezing temperatures.

Inside, Belgian Prime Minister Elio Di Rupo was assessing if anything could be done to save the 1,300 jobs at stake. ArcelorMittal blamed slumping demand for steel and structural overcapacity in Europe for its decision to close the plants.

The company said it would continue to operate five steel production lines, which employ 800 people.

Scientists from the Florida campus of The Scripps Research Institute (TSRI) have been awarded approximately $1.2 million from the National Institute of General Medical Sciences of the National Institutes of Health to identify, test and develop a series of drug candidates for a number of diseases, including rheumatoid arthritis, heart disease and several neurodegenerative disorders.

Derek R. Duckett, associate scientific director in TSRI's Translational Research Institute, and Peter S. Hodder, senior director of lead identification at the Translational Research Institute, will act as co-principal investigators for the three-year grant.

The project will focus on an enzyme known as ASK1, which is part of a larger family of mitogen-activated protein kinases (MAP kinases) that help control how cells respond to stress and is involved in mediating cell survival and programmed cell death (apoptosis). Genetic target validation studies have demonstrated that loss of this kinase shows remarkable efficacy in animal models of various diseases.

"While ASK1 is a highly druggable target, no tool compounds are currently available to probe its biology," Duckett pointed out. "This award will help us remedy the situation."

The new grant will allow the Scripps Florida scientists to perform a high-throughput screening campaign of the TSRI compound collection at their state-of-the-art screening facility. "Our team approach will identify the best lead molecules that will help define the roles that ASK1 plays in normal physiological processes as well as in disease states," Duckett said. "Such leads will also serve as good starting material for chemistry optimization efforts for future therapeutics."

"A very exciting prospect of this research effort is that Scripps's drug discovery compound collection will be assayed for novel inhibitors of ASK1 activity," said Hodder. "Past screening efforts with this collection yielded the antecedents of clinically relevant compounds, and the research plan we have in place bodes well for a similar outcome from this effort."
